THE LIMITED 10-YEARS PERGOLA WARRANTY

We provide the components of our Pergola with a LIMITED guarantee that shall be effective for up to ten years for the main structural frame and five years for ancillary parts such as the opening and closing mechanisms.

To benefit from the limited warranty, the original purchaser ("Customer") must complete the installation of our Pergolas by following the provided manual. The limited warranty applies from the installation date, subject to registration of the Pergola product as indicated under "warranty conditions" below.

The limited warranty is non-transferable and only extended to the Customer.

In all cases, the warranty is limited to the price paid for the product.

LIMITED WARRANTY

THIS LIMITED WARRANTY APPLIES ONLY WITHIN THE UNITED STATES. THIS LIMITED WARRANTY GIVES YOU SPECIFIC LEGAL RIGHTS AND YOU MAY ALSO HAVE OTHER RIGHTS, WHICH VARY FROM STATE TO STATE.

WE WARRANT THAT DURING THE WARRANTY PERIOD, THE PRODUCT(S) WILL BE FREE FROM DEFECTS IN MATERIAL AND WORKMANSHIP.

TO THE EXTENT NOT PROHIBITED BY LAW, THIS WARRANTY IS EXCLUSIVE AND IN LIEU OF ALL OTHER WARRANTIES, ORAL, WRITTEN, STATUTORY, EXPRESS OR IMPLIED. EXCEPT FOR THE EXPRESS WARRANTIES CONTAINED IN THIS LIMITED WARRANTY STATEMENT AND TO THE EXTENT NOT PROHIBITED BY LAW, WE DISCLAIM ALL OTHER WARRANTIES, EXPRESSED OR IMPLIED, STATUTORY OR OTHERWISE, INCLUDING WITHOUT LIMITATION, THE WARRANTIES OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE. SOME STATES DO NOT ALLOW DISCLAIMERS OF IMPLIED WARRANTIES, SO THIS DISCLAIMER MAY NOT APPLY TO YOU. TO THE EXTENT SUCH WARRANTIES CANNOT BE DISCLAIMED UNDER THE LAWS OF YOUR JURISDICTION, WE LIMIT THE DURATION AND REMEDIES OF SUCH WARRANTIES TO THE DURATION OF THIS EXPRESS LIMITED WARRANTY.

OUR RESPONSIBILITY FOR DEFECTIVE GOODS IS LIMITED TO PRODUCT REPLACEMENT, REPAIR OR REFUND OF PURCHASE PRICE, AS DESCRIBED BELOW IN THIS WARRANTY STATEMENT.

WHO IS THE WARRANTOR?

Hanso Home, Inc (“Hanso Home”), located at 401, 1007 N Orange St. 4th Floor, Wilmington, DE, New Castle, US, 19801 provides this upto 10-year limited warranty to the initial purchaser of products sold by Hanso Home (hereinafter referred to as, the “Products”).

WARRANTY CONDITIONS

The Customer must register the product within 30 days of delivery to activate the limited warranty by notifying support@hansohome.com of their desire to do so and attaching a copy of their proof of purchase. HANSØ considers the limited warranty active once HANSØ acknowledges the registration. The purchaser must notify Hanso Home Products promptly of any claims within the warranty period. Failure to do so may result in the claim being denied.

THE LIMITED 10-YEARS PERGOLA WARRANTY EXCLUSIONS

  1. Damage due to acts of God or force majeure, including without limitation: change of color caused by sun and salt, any damage resulting from smoke, fire, exceptional climatic conditions such as, without limitation, deep frosts, heavy snow, violent winds, lightning, heavy rain, black ice, hail, hurricanes, ground movement, flooding, overflow of any stream, as well as vandalism.
  2. Damage, direct or indirect, resulting from the negligence of the Customer, improper maintenance, or improper use of the product, including, without limitation, a source of direct or indirect heat, deletions, modifications, or additions made by the Customer, and any weight load on the louvers and the structure of the HANSØ Pergola.
  3. Direct or indirect damage resulting from incorrectly following the installation manual.
  4. Damage, direct or indirect, resulting from installation or improper storage, maintenance, or use by any person who does not meet the guidelines referred to by the Pergolas Installation Manual and Maintenance Guide.
  5. When the Pergola is installed on a concrete slab or other surface and is damaged, direct or indirect, resulting from movements in such a concrete slab or surface.
  6. The installation of the structure after one year following the date of installation.
  7. Any motor(s), lights, and electrical parts, if any, installed with the HANSØ Pergola.
  8. To the assembly and the efficiency of the components when the installation is not done by not following the installation manual correctly.
  9. Direct or indirect damage that may be caused by the Customer's structure on which the Pergolas product has been installed.
  10. Runoff or water infiltration between the wall and the Pergola in the case of an installation attached to a building. Our Pergolas are a free-standing construction and should not be attached to the buildings.
  11. The cost of packing, dismantling, storage, transport, and handling the Pergolas.

OTHER CONDITIONS AFFECTING THE LIMITED 10-YEARS PERGOLA WARRANTY

Application of the limited warranty shall be suspended without notice or delay if the Customer or Reseller has financial obligations in default to Pergolas and shall remain suspended until the Customer or Reseller has met these financial obligations to the satisfaction of Pergolas. Buying a Pergola's replacement part does not have the effect of extending the length of the limited warranty.

WARRANTY CLAIMS

Any claims under this limited warranty must be made in writing and received by email at support@hansohome.com within 30 days of discovery of the defect. The written notification must include the name and address of the Customer, a detailed description of the defect, photos to support the claim, the date of installation, the date the defect was discovered, the address where the product is installed, the name of the installer, and the address of the reseller and a copy of the invoice.

The Company will have the right to inspect the structure and the product upon receipt of a warranty claim. Repairs are to be avoided before the inspection by the Company. Any repairs or alterations to the product before an inspection may void the limited warranty at the Company's sole discretion.

After inspection, if the Company determines that the limited warranty is applicable, the Company, at its sole discretion and expense, will replace or repair the product or refund any amount paid by the Customer for the purchase of the company product, all within 180 days of receipt of the warranty claim.

The Customer must pay all labor charges generated by the Company after one year following the installation date.

In case of replacement of the product, if the same product is no longer available, it will be replaced by a product of equal value to the initial purchase value of the product being replaced.

WARNING

This written limited warranty is considered an official document and replaces all previous warranties and conditions, written or verbal, mentioned or given to the Customer by the Company.

The Company will not be held responsible, in any case, for the replacement cost of another product or for any direct or indirect operating loss.

THE WARRANTY FOR ACCESSORIES

The motor and its applications, lights, heaters, and electrical elements are guaranteed for one year from the effective date of the limited warranty if purchased simultaneously with a Pergola product. Lights, heaters, and electrical elements are guaranteed for one year from the purchase date when purchased separately.

THIS WARRANTY IS NOT A PERFORMANCE CLAIM. THIS LIMITED WARRANTY APPLIES ONLY WITHIN THE UNITED STATES.

 

 


 

 

LIMITED WARRANTY FOR AWNINGS AND ACCESSORIES

General Conditions

The following general conditions apply to this warranty:

  • Proper Use: The product must be installed, maintained, operated, used, and stored according to the instructions provided in the owner's manual. Any failure to comply with these instructions will void the warranty.
  • Notification of Claims: The purchaser must notify Hanso Home Products promptly of any claims within the warranty period. Failure to do so may result in the claim being denied.
  • Photographic Evidence: The purchaser may be required to provide photographic evidence of any defective parts before a warranty claim is processed.
  • Registration: The Customer must register the product within 30 days of delivery to activate the limited warranty by notifying support@hansohome.com of their desire to do so and attaching a copy of their proof of purchase. HANSØ considers the limited warranty active once HANSØ acknowledges the registration.

WHO IS THE WARRANTOR?

Hanso Home, Inc (“Hanso Home”), located at 401, 1007 N Orange St. 4th Floor, Wilmington, DE, New Castle, US, 19801 provides this upto 10-year limited warranty to the initial purchaser of products sold by Hanso Home (hereinafter referred to as, the “Products”).

WHO MAY USE THIS WARRANTY?

This limited warranty may be enforced by only the party who is the initial purchaser of Products manufactured and sold by Hanso Home. This limited warranty is not transferable.

WHAT DOES THIS WARRANTY COVER?

This limited warranty covers defects in materials and workmanship of the Product(s) upto a period of ten (10) years from the date of purchase. More specifically, Hanso Home warrants that its standard Products will conform to Hanso Home’s published product specifications. Each specific component or product warranty is outlined in the sections below:

Coverage Details

  • Structural Supports: Lateral arms, square bar, roller bar, front bar, and all other attached supports are warranted against material failure due to structural defects in material or workmanship for ten (10) years, provided the components are not subjected to excessive winds or water pooling.
  • Frame Finish (Paint): The paint finish is warranted for five (5) years against chipping, blistering, and peeling, provided it is used properly.
  • Fabric: The fabric is warranted for ten (10) years against excessive loss of color or strength, provided it is not subjected to excessive winds or water pooling. The first five (5) years offer a 100% discount on replacement fabric, years six (6) to eight (8) offer a 50% discount, and years nine (9) to ten (10) offer a 25% discount.
  • Gear Mechanism (Manual Models): The gear mechanism is warranted for five (5) years against failure under proper use.
  • Electric Motor (Motorized Models): The electric motor is warranted for five (5) years against failure under proper use.
  • Awning Accessories: Accessories attached to the awning are warranted for five (5) years against failure under normal conditions, provided they are used and maintained according to the owner's manual.

WHAT DOES THIS WARRANTY NOT COVER?

This limited warranty does not cover any damage, product failure or poor product performance due to: (a) normal wear and tear; (b) transportation or installation on moving vehicles; (c) storage; (d) misuse, abuse or failure to properly provide maintenance as per the Product Manual; (e) improper installation not in conformance with Hanso Home’s product manual or application drawings or instructions; (f) alterations or modifications; (g) unauthorized repair or using replacement products not sold by Hanso Home; (h) external causes such as accidents, , abuse, fire, lightning, hurricane, high winds, or other actions or events beyond Hanso Home’s reasonable control; (i) the negligence, gross negligence or willful misconduct of any third party; (j) vandalism or attack by any party; (k) defects in the structure or a component of the structure (i.e., window, or wall system) or selection and use of incompatible and/or inappropriate components which negatively affect the performance of the Product(s); (l) contamination from, or exposure to, chemicals; (m) nonstandard use or application of the Product(s); (n) foreign objects or agents, including the use of materials incompatible with the Product(s); and/or (o) the reuse of the Product(s) in a second installation.

WHAT IS THE PERIOD OF COVERAGE?

This limited warranty starts on the date of the initial purchaser’s purchase of the Product(s) and lasts upto a period of ten (10) years (the “Warranty Period”). The Warranty Period is not extended if Hanso Home replaces the Product. Hanso Home may change the availability of this limited warranty at its discretion, but any changes will not be retroactive.

WHAT ARE YOUR REMEDIES UNDER THIS WARRANTY?

If any Product manufactured by Hanso Home is found to be defective by Hanso Home, in its sole judgment, Hanso Home will, at its option either repair or replace with the same or substantially equivalent replacement for such defective product, or refund the purchase price. Any repaired or replaced Product is covered only for the remainder of the warranty period. The Warrantee must reasonably cooperate with Hanso Home or its representatives in their efforts to perform their obligations under this Warranty.

HOW DO YOU OBTAIN WARRANTY SERVICE?

To obtain warranty service, you must promptly email Hanso Home’s Customer Service Department at support@hansohome.com during the Warranty Period to report any potential claim, no later than thirty (30) days after you discover the potential claim. The following information must be submitted with the warranty claim: (1) name and address of claimant; (2) product number (if applicable) and description of the Product(s); (3) proof of purchase; and (4) description of the problem or defect. (5) Photographs to support your claim. At Hanso Home’s request, you must provide Hanso Home or its representatives with a reasonable opportunity to inspect and/or test the Product(s) to determine whether or not the Hanso Home Product(s) failed as set forth herein.

Hanso Home will advise the purchaser of its position with respect to the warranty claim. In the event a Product is to be returned to Hanso Home under this limited warranty, the Product returned must be suitably packed. Upon receipt of the Product and determination by Hanso Home that this Limited Warranty applies, Hanso Home will perform the warranty repair, or replace the Product, or refund the purchase price for the Product, as required in accordance with this Limited Warranty. Any Product that is repaired or replaced will be returned to the initial purchaser freight collect. All Products replaced or for which the purchase price has been refunded become the property of Hanso Home.

LIMITATION OF LIABILITY

THIS LIMITED WARRANTY IS EXCLUSIVE. HANSO HOME MAKES NO OTHER WARRANTY OF ANY KIND WHATSOEVER, EXPRESS OR IMPLIED, WITH RESPECT TO THE PRODUCTS MANUFACTURED AND SOLD BY IT, WHETHER AS TO ANY WARRANTY OR MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE OR ANY OTHER MATTER.

HANSO HOME’S LIABILITY IS LIMITED ONLY TO THE REPLACEMENT VALUE OF THE PRODUCT. HANSO HOME SHALL NOT IN ANY EVENT BE LIABLE TO ANY BUYER FOR CONSEQUENTIAL, INDIRECT, INCIDENTAL OR SPECIAL/PUNITIVE DAMAGES OF ANY KIND, OR FOR THE LABOR CHARGES WHICH MAY BE REQUIRED FOR THE REMOVAL, REPLACEMENT OR REINSTALLATION OF SAID PRODUCT, WHETHER FOR BREACH OF WARRANTY, NEGLIGENCE, ON THE BASIS OF STRICT LIABILITY, OR FOR ANY OTHER REASON.

SOME STATES DO NOT ALLOW THE EXCLUSION OR LIMITATION OF INCIDENTAL OR CONSEQUENTIAL DAMAGES, SO THE ABOVE LIMITATION OR EXCLUSION MAY NOT APPLY TO YOU.

The purpose of this exclusive remedy shall be to provide the initial purchaser with repair and replacement of Products manufactured by Hanso Home found to be defective in materials or workmanship or negligently manufactured. This exclusive remedy shall not be deemed to have failed of its essential purpose as long as Hanso Home is willing and able to repair or replace said defective products in the prescribed manner.

The foregoing is the only Warranty made by Hanso Home for Hanso Home Products. No representative, dealer or any other person is authorized to make, or makes, any warranty, representation or promise on behalf of Hanso Home with respect to Hanso Home Products. No terms or conditions other than those stated herein or provided by law, and no agreement or understanding, oral or written, in any way purporting to modify this Warranty shall be binding upon Hanso Home unless made in writing and signed by an authorized representative of Hanso Home.

THIS WARRANTY IS NOT A PERFORMANCE CLAIM. THIS LIMITED WARRANTY APPLIES ONLY WITHIN THE UNITED STATES.

GOVERNING LAW/VENUE

This Limited Warranty shall in all respects be governed by the laws of Delaware, US. This Limited Warranty Policy is effective as of August 08, 2024

BINDING ARBITRATION

Any dispute, claim or controversy between you and Hanso Home arising out of, or related to, this Product(s) Limited Warranty is subject to binding arbitration on an individual basis in accordance with the terms mentioned in the Terms of Purchase on Hanso Home’s Website.
